The City will review and advertise local planning policies on a case-by-case basis depending on the extent of the changes and in line with the Deemed provisions.

The City's review of local planning policies seeks to update the City’s administrative, issue and area-specific policies to ensure they are relevant and facilitate appropriate community views and development outcomes. These reviews will also meet current legislative requirements.

The City regularly invites submissions for all newly drafted or amended local planning policies for a minimum of 21 days as they are developed and approved by the Council for community engagement purposes.

This site provides all notices of drafted and amended policies, information on the status of policies and provides you with the opportunity to give feedback.

The City believes community input provides valuable information to assist the Council in making decisions regarding approval of policies.

How can you get involved, find out more or provide feedback?

    The Council at their Ordinary Council Meeting in May 2020 resolved to prepare and advertise Draft Local Planning Policy Alexander and Philip Road Dalkeith Building Height. This Policy is for the purpose of modifying the deemed to comply/acceptable outcome building heights for several properties on Alexander and Philip Roads, Dalkeith.

    The Council at its May 2020 Ordinary Council Meeting adopted the Local Planning Policy - Interim Built Form Design Guidelines – Broadway Mixed Use Zone. This policy provides guidance on the planning and design of development within the Broadway Mixed Use Zone.

    The report to Council can be found on the City's website under Council/Agendas, Minutes and Reports.

    Please note that some sections of the policy still require approval from the Western Australian Planning Commission in accordance with Clause 1.2.3 of the Residential Design Codes Volume 2.

    City of Nedlands Council resolved at the May 2020 Ordinary Council Meeting to revoke the following Local Planning Policies in accordance with the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2, Part 2, Clause 6; the Ancillary Accommodation Local Planning Policy and the Subdivision Local Planning Policy. Council also resolved at this meeting to revoke the Tennis Court Fencing & Lighting Council Policy.

    The City has created a dedicated page for existing and future laneways within the City!

    The City is currently creating an overarching plan in relation to the widening of existing laneways and the creation of future laneways throughout the City but in particular which service properties that have been up coded/rezoned under Local Planning Scheme 3 (LPS3).

    This page provides more details about the ways in which the City is using a series of planning instruments to develop and implement a holistic approach to the management and creation of laneways throughout the City.

    The Council at its April 2020 Ordinary Council Meeting resolved to prepare and advertise for a period of 21 days the Jenkins Laneway Policy Local Planning Policy. This policy provides laneway requirements for the establishment of an east-west laneway between Taylor Rd to Dalkeith Rd.

    FAQs

    1. Why is the City proposing the allocation of a laneway?

    The City is proposing the allocation of a laneway between Taylor Rd and Dalkeith Rd to reduce the number of crossovers addressing Jenkins Ave. Following the gazette of the City of Nedlands Local Planning Scheme No. 3, properties to the immediate north of Jenkins Ave have been ‘up-coded’ to R60, which allows blocks to be subdivided into five (5) new lots. Each lot is entitled to a 6.0m wide vehicle driveway and crossover. To reduce the impact of the intensification of the land use on the adjoining ‘Safe Active Street’ (Jenkins Ave) and to minimise the creation of vehicle crossovers addressing the streetscape, the City is proposing the allocation of a laneway to remove vehicle access from the existing street network.

    1. When will land be required to be ceded to the City?

    Land owners are only required to cede land at the time of ‘significant’ redevelopment or subdivision. There is no requirement to cede land unless a development application or subdivision is applied for and subsequently approved.

    1. How does this policy affect property values?

    The City is currently pursuing a Scheme Amendment, which would allow the land area of a lot (pre-ceding) to be used as the development potential of a lot for the purposes of a development application. Subdivision and development potential is not proposed to be impacted by the Local Planning Policy.
