Local Planning Policies - Reviews and Development

The City will review and advertise local planning policies on a case-by-case basis depending on the extent of the changes and in line with the Deemed provisions.

The City's review of local planning policies seeks to update the City’s administrative, issue and area-specific policies to ensure they are relevant and facilitate appropriate community views and development outcomes. These reviews will also meet current legislative requirements.

The City regularly invites submissions for all newly drafted or amended local planning policies for a minimum of 21 days as they are developed and approved by the Council for community engagement purposes.

This site provides all notices of drafted and amended policies, information on the status of policies and provides you with the opportunity to give feedback.

The City believes community input provides valuable information to assist the Council in making decisions regarding approval of policies.

How can you get involved, find out more or provide feedback?

  • Read the documents relevant to each policy review in the document library.
  • Complete the online submission relevant to the policy you are commenting on (including uploading attachments).
  • Read the FAQs to find out more about the proposals and the process for review.

  • Local Planning Policy: Smyth Road, Gordon Street and Langham Street Laneway and Built Form Requirements - Adopted 23 June 2020

    The Council at their Ordinary Council Meeting on 23 June 2020 resolved to adopt Local Planning Policy: Smyth Road, Gordon Street and Langham Street Laneway and Built Form Requirements in accordance with the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2, Part 2, Clause 4, following community consultation.

    Please note that this policy requires approval from the West Australian Planning Commission in relation to modification of State Planning Policy 7.3 Residential Design Codes Volume 1 in accordance with clause 7.3.

    This Policy is available as part of the City's Local Planning Policies accessed via the City's website and copies can also be viewed at the City's Administration Building located at 71 Stirling Highway, Nedlands, WA 6009.

  • Advertising Modifications to LPP – Waste Management

    The Council at their Ordinary Council Meeting in July 2020 resolved to prepare and advertise modifications to the Waste Management Local Planning Policy. This policy details the requirements relating to waste management and minimisation to be considered in the design of any proposed development as per the City’s Waste Management Guidelines.

    The City’s Waste Local Planning Policy (Waste LPP) and Guidelines were adopted in March 2020 by Council. Since adoption of this policy, however, planning applications have been received that demonstrate the policy’s requirement for ‘inside-servicing’ for development applications exceeding 5 dwellings has resulted in proposed adverse built form outcomes. In consultation with Council, the City has made minor changes to the policy to be in line with best practice and encourage better built form outcomes.

    The draft Local Planning Policy – Peace Memorial Rose Garden Precinct, Nedlands will be presented to Council for final adoption at a Special Council Meeting on Thursday 3 September 2020.

  • Local Planning Policy Occupancy Restrictions - Adopted 28 July

    The Council at its July 2020 Ordinary Council Meeting adopted the Occupancy Restrictions Local Planning Policy in accordance with the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2, Part 2, Clause 4, following community consultation.

    The Council at their Special Council Meeting on 4 August 2020 resolved to prepare and advertise Draft Local Planning Policy Residential Aged Care Facilities. This Policy is for the purpose of establishing development provisions for operators seeking to establish Residential Aged Care Facilities within the City of Nedlands. This LPP replaces the former LPP Residential Aged Care Facilities that was revoked by Council on the 28 July 2020.

    City of Nedlands Council resolved at the July 2020 Ordinary Council Meeting to revoke the Residential Aged Care Facilities Local Planning Policy in accordance with the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2, Part 2, Clause 6.

    At its 30 June 2020 Statutory Planning Committee meeting, the Western Australian Planning Commission resolved to refuse the landscaping provision in the City’s Local Planning Policy – Residential Development: Single and Grouped Dwellings. This provision has now been removed from the policy.

This Policy is for the purpose of providing guidance and development provisions for operators seeking to establish short-term accommodation within the City of Nedlands.

    The Council at its Ordinary Council Meeting on 23 June 2020 resolved to amend and advertise Draft Local Planning Policy Nedlands Town Centre Precinct Plan. The amendments to the Policy relate to plot ratio and community benefit measures.
