As the City's residential population continues to grow, so too will the pressure on the provision of appropriate housing options within the City for residents. The City also appreciates that it can reasonably be expected that there may be a preference for existing residents in the more senior age brackets to continue to reside within the City. For those aged residents who are not able to or wanting to remain in their existing residential properties, a Residential Aged Care Facility will provide an ideal option to remain in the City.

How is the City planning for the future?

At present, the City makes provision for the development of Residential Aged Care Facilities, through Local Planning Scheme No.3 (LPS3) provisions and a Local Planning Policy (LPP).

A 'Residential Aged Care Facility' is defined in the Scheme as:

“a residential facility providing personal and/or nursing care primarily to people who are frail and aged and which, as well as accommodation, includes appropriate staffing to meet the nursing and personal care needs of residents; meals and cleaning services; furnishings, furniture, and equipment. May also include residential respite (short term) care but does not include a hospital or psychiatric facility.”

The City of Nedlands supports Residential Aged Care Facilities in areas where such facilities can be congruent with the existing character and context of that local area.

Where are Residential Aged Care Facilities permitted?

In general, when considering any applications for development for a residential aged care facility, the City will take into consideration its appropriateness within the local context to help inform decision making. A Residential Aged Care Facility land use will be considered in areas zoned 'Residential' and 'Mixed Use'. The Local Planning Scheme classifies a Residential Aged Care Facility as an 'A' use in these zones under 'Table 3 - Land Use' in the Scheme.

Exception, however, applies to those properties listed under Clause 19 - Additional Uses, Table 4, where a 'Residential Aged Care Facility' is a permitted use.

What is the City doing to facilitate the development of Residential Aged Care Facilities within the City?

The City is undertaking a number of initiatives to provide the community with greater certainty about how and where Residential Aged Care Facilities will be developed in the future. To find out about the City's latest initiatives, take a look at our 'City's Initiatives' tab below.

  • Scheme Amendment No. 11 - Additional Built Form Requirements

    The Council at their Ordinary Council Meeting on 28 July 2020 resolved to prepare for advertising Standard Scheme Amendment No.11 to the City of Nedlands Local Planning Scheme No. 3. The City has now received correspondence back from the Environmental Protection Authority (EPA) and can proceed with the formal public advertising of the proposed Scheme Amendment.

    This Scheme Amendment was initiated as a result of a recent application received for a residential aged care facility within a Residential Zone within the City. This Scheme Amendment proposes the introduction of an additional sub-clause to Clause 32, being Sub-clause 32.7, which provides clearer guidance relating to built form requirements for all non-residential developments proposed within a Residential Zone under the Local Planning Scheme No.3.

    The Council at their Ordinary Council Meeting in July 2020 resolved to prepare for advertising Standard Scheme Amendment No. 10 to the City of Nedlands Local Planning Scheme No. 3.

    This Scheme Amendment is for the purpose of adding conditions to Additional Use 9 (A9). The amendment proposes to include specific built form controls as conditions for Residential Aged Care Facilities where they are proposed at the following addresses are listed under A9 in the Additional Use Table of the Scheme under Clause 19:

    • Lot 25 (69) Melvista Avenue, Nedlands,
    • Lots 10 (16) and 11 (18) Betty Street, Nedlands and
    • Lots 19 (73) and 18 (75) Doonan Road, Nedlands .

    The City of Nedlands advises the Local Planning Policy - Residential Aged Care facilities will be presented for consideration at the Special Council Meeting on Thursday 3 September 2020.
    The meeting will begin at 6pm and will be held in the Ellis Room at Bendat Basketball Centre, 201 Underwood Ave, Floreat.

    Due to COVID Restrictions the 2m², with 1.5 metre social distancing rule applies.
    Those who wish to address the Council regarding the above proposal are required to complete the forms here.
    Once the venue is at capacity no further admission into the room will be permitted.

    This meeting will also be livestreamed, accessed via the City's website.

    The Council at their Special Council Meeting on 4 August 2020 resolved to prepare and advertise the Draft Local Planning Policy for Residential Aged Care Facilities. This Policy is for the purpose of providing guidance and development requirements relevant to applications for Residential Aged Care Facilities (RAC Facilities) within the City of Nedlands. This LPP replaces the former LPP Residential Aged Care Facilities that was revoked by Council on the 28 July 2020.

    The Policy is available for viewing in the document library and for comment via the submission form.
