The City of Nedlands receives numerous development applications each year which require community consultation for numerous reasons such as the City requiring the use of discretion in decision making or the type of development application requiring community consultation as per City Policy.

This engagement page is a central place to view and provide submissions on all current development applications of a standard or basic nature such as single and grouped dwelling developments, home business applications and change of use applications. Significant development applications will be advertised on a separate page.

    “means that the use is not permitted unless the local government has exercised its discretion by...

    “means that the use is not permitted unless the local government has exercised its discretion by granting development approval after giving notice in accordance with clause 64 of the deemed provisions.”

    Please note that the home business has already commenced, and the applicant has advised the following:

    • The proposed home business is for the production of Indian sweets.
    • The business is limited to the kitchen and associated store rooms, contained within the dwelling (as indicated on the plans).
    • The business is operated by the homeowner, who resides in the property and one employee, who does not live on the property.
    • The business makes deliveries once to twice a month, via means of a Campbells small delivery truck.
    • Deliveries to the property are conducted between 10am and 4pm.
    • The business operates Tuesday to Friday, 10am-4pm.
    • No signage or advertising is proposed as part of the business.
    • Approximately 50kg of sweets are produced each week.
    • Products produced are to be distributed to selected Indian Grocery Stores at the end of each week. (Friday)

    The Deemed-To-Comply Requirement C3.2 of Clause 5.1.3 Lot Boundary Setbacks of the Residential Design Codes (R-Codes) states that walls may be built up to a lot boundary behind the street setback where the wall abuts an existing or simultaneously constructed...

    The application is being advertised because the development requires an assessment against the Design Principles of the Residential Design Codes for the lot boundary setbacks and the streetscape.

    Clause 5.1.3 – Lot Boundary Setbacks:

    The Deemed-To-Comply Requirement C3.2 of Clause 5.1.3 Lot Boundary Setbacks of the Residential Design Codes (R-Codes) states that walls may be built up to a lot boundary behind the street setback where the wall abuts an existing or simultaneously constructed wall of similar of greater dimension.

    This application has been advertised for comment because the proposed boundary wall is of a greater dimension to the already existing boundary wall at 93 Alderbury Street, Floreat.

    Streetscape: Alderbury Street, Floreat

    The proposed additions to the Single Dwelling are compliant with the 9m setback requirement as per Clause 26(1)(a)(i) of the City of Nedland’s Local Planning Scheme No. 3. However, the additions to the dwelling encroach into the front setback area. Even though these additions will be line with the front entrance of the dwelling, the additions are not in line with the boundary wall of the adjoining landowner to the East (93 Alderbury Street, Floreat). As a result, the application has been advertised to properties to the North of 95 Alderbury Street, Floreat to seek comment on the proposed additions.

    Retaining walls are also proposed with the application. However, the retaining walls are compliant with the relevant clauses of the R-Codes.
