On 14 August 2019, the City received an application for a seven-storey building comprising of 26 serviced apartments and a ground floor cafe which was refused by the Metro-West Joint Development Assessment Panel (JDAP) on 18 December 2019.
The applicant has since appealed this decision to the State Administrative Tribunal (SAT) and following mediation has submitted amended plans. Due to the timeframes imposed by SAT, the advertising period to comment is limited.
Submissions closed at 5pm on Wednesday 4 March 2020. Please note, late submissions cannot be accepted.

The proposed amendments, as presented in the submission are summarised below:
A residential component has been incorporated into the design with a consequent reduction in the number of serviced apartments in the following configuration: - Provision of eight (8) new multiple dwellings located on the second floor to fifth floor at the rear (west) of the building; - A reduction of five (5) serviced apartments, from 26 to 21 located on the first floor to fifth floor; - A reduction in the number of cafe patrons from a maximum of 12 patrons to 10 patrons and modifications to the cafe's street interface.
A new basement level and basement mezzanine has been incorporated to the design, removing car parking from the first floor level. An overall increase in car parking from 21 to 37 bays for residents, visitors and café patrons is proposed through the use of car stackers. Car parking is now concealed from the street and the vehicle crossover has been widened to 5.6m.
Overall the number of storeys has remained the same (seven storeys) with a maximum height of 19.4. However, as viewed from the primary street, the development presents as a six (6) storey building to the street and four (4) storey building to the rear, due to the seventh floor being recessed.
A new landscaping plan is proposed which introduces: - Additional plants and trees primarily towards the rear of the building; - Landscaping boxes on balconies have been incorporated into the design on the rear facing multiple dwelling units; - New landscaping species.
Modification to the proposed palette of materials, finishes and colours which now include face brick wall and recycled brick, feature metal cladding, white render, excavated limestone, and architectural metal panels.
The overall setbacks from the building have been modified: - Rear facing units are set back at between 7.4m and 7.5m at the upper levels; - The development proposes a nil setback up to the first floor and setbacks that range between 1.5m to 2.75m on the second and fifth floor. The sixth-floor ranges between 1.5m to 3.3m to the northern boundary and 3m to the southern boundary; - The sixth-floor plan has been modified and as a result, has increased its setback from the primary street.
Inclusion of additional balcony screening to the rear and increased rear setbacks to avoid overlooking.
A reduced plot ratio of 2.17:10 due largely to the relocation of car parking to the basement.
