Consultation has concluded

The Minister has advised that the Scheme was published in the Government Gazette on Tuesday, 16 April 2019 which completes the approval process.

The Local Planning Scheme No. 3 changes the zoning, land use permissions, density codes and development standards for the City of Nedlands.

To assist the community in understanding the new requirements a series of information sessions will be held throughout May.

The approval of LPS3 will enable the City to commence developing its planning framework of policies and procedures to support its implementation.

Further community engagement will be undertaken as these projects progress.

    The second open day at Dalkeith was a success with approximately 55 people attending to discuss their thoughts and concerns with the City's planners. Everyone who attended was encouraged to make a submission, in whatever format is easiest for them. Don't forget that you can send us attachments too, via the Council email, council@nedlands.wa.gov.au

    We are nearly half way through the community engagement process and sending us a submission will ensure that the City can capture everyone's thoughts and provide an accurate report back to Council.

    Our third Open Day is being held in the Council Chambers (entry on Smyth Road) at the Administration Centre from 9am-1pm on Saturday, 24 February.

    The first open day at Mt Claremont was a success with approximately 60 people attending. Opinions and views about proposed Local Planning Scheme 3 were wide and varied. Everyone who attended is encouraged to make a submission, in whatever format is easiest, so we can capture everyone’s thoughts and report accurately back to Council.

    For those people who have not attended an open day yet - don’t forget, the next one will be at Dalkeith Hall this Thursday evening from 4pm – 7pm. Please feel free to drop in and have a chat to a planner.

  • How the City developed the draft Local Planning Scheme No. 3

    During 2016, and following the completion of the Local Planning Strategy, the City progressed with the preparation of the draft Local Planning Scheme No. 3 (LPS3) for the City of Nedlands.

    The Draft LPS3 was presented to the Council at a special meeting held on 13 December 2016 who subsequently adopted the draft document for forwarding to the State Government's WA Planning Commission (WAPC) for review. Please the City's website (Your Council) to view the report (Agenda), Minutes (including the draft LPS3 as presented to Council).

    The WAPC reviewed the draft LPS3 and asked the City to make a number of modifications which were subsequently made by the City. Following acceptance of the modifications, the WAPC approved the scheme for release to the community for comment which is currently underway.

    One of the most significant modifications required by the State Government was for all local authorities to accommodate additional dwellings. For Nedlands, this means increased residential densities. The City has been required to accommodate 4,400 additional dwellings. This can be achieved by re-zoning areas along the Stirling Highway, Hampton Road and Broadway - as Council had originally proposed.

    But, the WAPC required the residential density codes to be increased and applied to more areas. Areas affected by this change include:

    • R160 applied to an area bordering Stirling Highway
    • R60 and R40 applied to specific areas along Stirling Highway
    • R60 and R40 applied to an area west of Hampden Road and an area west of Broadway
    • R60 applied to an area near QEII Medical Centre
    • R80, R60, and R40, applied to areas surrounding Dalkeith Village
    • R20 applied to an area of Mt Claremont.


    Other WAPC modifications include:

    • Changed provisions - resulting in mandatory controls now being discretionary and possibly determined by the Development Assessment Panel. This affects building heights in your local commercial centres, mixed-use and residential zones bordering Stirling Highway, Hampden Road, Broadway and the Subiaco wastewater treatment plant buffer
    • A number of land-use definitions and permissions were changed, affecting fast food outlets, lunch bars, takeaway food outlets, shops and short-stay accommodation
    • The mixed residential zone was removed and replaced with a purely residential zone.
    There is a view that changes are being forced on the community by the State Government and they may not align with community expectation. Ultimately it is the community that should determine the look and feel of the area they live in.

    What are the implications for the proposed changes? This depends on your personal circumstances and what your views or land use in the City of Nedlands should be. Residents may be directly or indirectly affected in a number of ways (for further information, please refer to the FAQs).

    The City of Nedlands urges you to make your views known through our comment period on this engagement page. The Council can then feed these views back to the WAPC - it has the ultimate power to decide what the final Local Planning Scheme contains.

  • Beware of fake planning scheme flyer!

    The City of Nedlands has been made aware of a fake flyer (see image) circulating in parts of Mt Claremont that contains false information about proposed changes to draft Local Planning Scheme No. 3. These incorrect details relate to possible modifications to residential densities, commonly referred to as R-Codes.

    It is really important that you access the correct information and not rely on any unauthorised flyers.

    To confirm, the draft LPS3 proposes an increase in density from R10 to R20 in some parts of Mt Claremont with no change to the existing maximum height permitted.

    The City is giving everyone every opportunity to have their say by having a four-month consultation period and using numerous methods to ensure you can gain the information you need to know.

    Whether it’s letters to residents, online information, advertising, community open days or even talking to the planners themselves, the City is committed to keeping the community informed in a fair and open manner.
