Consultation has concluded

The City is undertaking the preparation of a Draft Local Planning Policy relating to Existing Laneways. The objective of this local planning policy is to provide greater certainty for landowners whose properties abut an existing laneway.

Background

The City of Nedlands Local Planning Scheme No.3 upcoded a number of properties throughout the City, increasing the development potential of several residential zoned properties. The increased development potential has introduced potential access issues to these newly created lots. For those properties which already abut an existing laneway, the City recognises that those affected properties might seek to realise the introduced development potential and that certainty relating to existing laneway treatment and construction needs to be provided to those abutting landowners.

How are existing laneways currently dealt with?

The City presently relies on Clause 32.3 of the Local Planning Scheme No.3 to facilitate laneway development. Clause 32.3 allows the City to require that a developer create a laneway through ceding and constructing that laneway at the developer's cost. This can be triggered where that laneway is identified by the scheme or a structure plan, local development plan, activity centre plan or local planning policy at the time of the owner developing or subdividing the land.

The City has received feedback from the DPLH and WAPC, which has also been reflected in legal advice, that the City needs to have a more robust policy framework to guide laneway development, particularly in relation to the need to strengthen the connection between requiring land to be given up free of cost and demonstrating what the public benefit of that land ceded will have.

In response, the City has prepared draft Local Planning Policies for both Consolidated Access and Existing Laneways respectively to help provide better guidance and certainty for those affected landowners that may be considering developing their properties which now have increased development potential.

The City is presently undertaking engagement on the draft Local Planning Policy for Existing Laneways. This engagement will be complemented by targeted engagement with local residents in the following three study areas:

How to get involved

The City's previously cancelled Community Information Session that was scheduled for 25 February 2021 has been rescheduled to take place on 30 March 2021 between 4pm and 5pm. 

This Community Information Session will be available to all the community members to attend. You can register to attend by clicking on the link below.

Are you located in one of the study areas? 

If you are a local resident or ratepayer located in one of the study areas, you can register to attend your local study area workshop below. If you are not located in one of the study areas, you are welcome to attend the Community Information Session to be held.
