Consultation has concluded

The City is currently progressing with the proposed Scheme Amendment No.7 to Local Planning Scheme No.3 (LPS3) that relates to decreasing the density coding of several properties within the Broadway Precinct.

Background

Local Planning Scheme No. 3 (LPS3) was gazetted on 16 April 2019. Modifications from the Minister for Planning introduced changes to the Scheme that increased the density coding along Broadway and surrounding streets Kingsway, Hillway, Elizabeth Street and Edward Street, Nedlands as follows:

  • Numbers 2 to 36 Kingsway and 42 to 96 Kingsway: increased from R12.5 to R60;
  • Numbers 1 to 5 Hillway: increased from R12.5 to R-AC3;
  • Numbers 7 to 23 Hillway: increased from R12.5 to R60;
  • Numbers 69 to 131 Broadway: increased from R35 to R-AC3;
  • Numbers 133 to 139 Broadway: increased from R12.5 to R-AC3;
  • Number 2 Edward Street: increased from R12.5 to R60; and
  • Numbers 1, 1A and 1B Elizabeth Street: increased from R35 to R-AC3.

The City of Nedlands Council resolved at its Council Meeting on 25 February 2020 to proposed to initiate a scheme amendment to change the current density codes for these properties to:

  • Numbers 2 to 36 Kingsway and 42 to 96 Kingsway from R60 to R40;
  • Numbers 7 to 23 Hillway from R60 to R40;
  • Numbers 1 to 5 Hillway from R-AC3 to R-AC4;
  • Numbers 69 to 139 Broadway from R-AC3 to R-AC4;
  • Numbers 2 Edward Street from R-AC3 to R-AC4; and
  • Numbers 1, 1A and 1B Elizabeth Street from R-AC3 to R-AC4.

What has happened so far?

The proposed Scheme Amendment was initiated by Council resolution in February 2020. Following this resolution, supporting scheme amendment documentation was prepared, and consent to adopt and advertise the scheme amendment in late April 2020 as a standard scheme amendment for a period of 42 days.

Submissions were received from the community and the scheme amendment was referred back to Council on 3 September 2020, where it was resolved to support the Scheme Amendment. The Scheme amendment was referred to Western Australian Planning Commission (WAPC) on 4 September.

In late September 2020, the WAPC advised the City that the scheme amendment was considered to be a complex scheme amendment and that it would need to be re-advertised for a period of 60 days, to comply with the provisions of the Planning and Development (Local Planning Schemes) Regulations 2015 (the Regulations)

What does this mean to you?

An opportunity to provide comment on the proposed Complex Scheme Amendment No.7 is now available. If you have previously lodged a submission when Scheme Amendment No.7 was advertised, you will be required to re-lodge your submission.

Previous submissions received will not be considered.

Submissions will close 5pm Sunday 31 January 2021.*

*Please note that an extended consultation period has been applied to comply with the City's Local Planning Policy - Consultation For Planning Proposals consultation exclusion period, as outlined in Clause 5.13.

Please note: the Justification Report refers to the Scheme Amendment as a Standard Amendment rather than a Complex Amendment. This is the Justification Report that has been endorsed by Council, and therefore the WAPC have directed the City that this should be advertised, as Council have not endorsed the Scheme Amendment as Complex.
